The State of Sexual & Reproductive Health Care in Montana

A confusing array of recent court rulings, legislation, and new administrative rules have all left Montanans wondering, what care is still legally available?
So let’s get a few points straight.

  • Is abortion still legal in Montana?

YES! Our state constitution protects our right to abortion under Article II, Section 10 in the Right of Privacy.

  • I’m a teen. Can I still receive gender-affirming health care like puberty blockers?

  • I’m on Medicaid. Is abortion still covered for me?

YES! Medicaid recipients can still use their Medicaid benefits — including receiving coverage for abortion — due to a district court judge temporarily blocking two related policies attacking abortion rights.

  • I’m 15 years old. Do my parents have to give their consent for me to access abortion?

NO! Parental consent is not required to receive an abortion if you’re under 18. However for patients under 16, a law requiring parents be notified at least 48 hours in advance is currently in effect with some exceptions.

  • Is using telehealth for abortion still legal in Montana?

YES! Telehealth care for abortion is still available in Montana while courts decide the fate of the law that threatened to ban it.

  • Is a waiting period legally required in order to receive an abortion?

NO! Patients seeking an abortion can receive care as soon as a clinic is able to schedule an appointment or mail abortion medication.

  • Does the law require me to get an ultrasound in order to receive an abortion?

NO! You are not required to receive, view, or listen to an ultrasound prior to your abortion. Two legislative policies that sought to add this requirement are currently facing lawsuits and cannot be enforced unless they are upheld.

  • Can I take my kids to a drag story hour happening at my local bookstore?
