Enshrining abortion laws in state code

House Bill 432

Sponsored by Rep. Laurie Bishop (D - Livingston)

This bill was tabled in House Judiciary Committee on a party-line vote.

In 1999, the Montana State Supreme Court affirmed that Montanans’ constitutional right to privacy includes our reproductive rights: “Article II, Section 10 of the Montana Constitution broadly guarantees each individual the right to make medical judgments affecting her or his bodily integrity and health in partnership with a chosen health care provider free from government interference. More narrowly, we conclude that Article II, Section 10, protects a woman's right of procreative autonomy-i.e., here, the right to seek and to obtain a specific lawful medical procedure, a pre-viability abortion, from a health care provider of her choice.”  Rep. Bishop’s bill would ensure that Montanans are able to receive abortion care, eliminate harmful anti-abortion laws, and restore the ability of abortion-providing organizations such as SRHC members Blue Mountain Clinic and Planned Parenthood of Montana to provide sex education in schools.
